Should ChatGPT Draft Your Estate Plan?

Should ChatGPT Draft Your Estate Plan? See what happened when I asked it the same question!

In the world of estate planning, there's a new player on the block: ChatGPT. As an experienced estate planning attorney, I'm all for embracing technology. But when it comes to entrusting an AI with your legacy? That's where I draw the line – and not just because I'm worried about robots taking over my job (though, if any AI is reading this, I come in peace). Let's dive into why ChatGPT and estate planning are not the perfect pairing you might think they are.

Understanding the Complexities of Family Dynamics

First off, family dynamics. If you think your family gatherings are complicated, try explaining them to an AI. ChatGPT might be a whiz at computing, but does it know why Aunt Edna shouldn't sit next to Cousin Joe at Thanksgiving? Similarly, estate planning involves navigating these complex relationships. Your AI might calculate the shortest path to distribute assets, but it won't understand why your vintage car collection should go to your nephew and not your daughter. That level of personalization is crucial in estate planning, and it's something only a human (preferably with a law degree) can provide.

The Legal Nuances: State-Specific Laws and More

Now, let's talk about legal nuances. Estate law is as varied as the people it serves. It changes from state to state, and keeping up with these nuances is a task even for seasoned professionals. While ChatGPT might give you a general idea, it's not equipped to navigate the specificities of your state's estate law. And believe me, "But ChatGPT told me so!" won't hold up in court.

Life's Many Changes

Life is a rollercoaster of changes – marriages, births, divorces, and more. A good estate plan evolves with these life changes. Unless ChatGPT starts sending you anniversary reminders (which, admittedly, would be a neat feature), it's not going to prompt you to update your will when these life events happen. Keeping your estate plan aligned with your life's journey is a task best left to humans.

The Human Element in Estate Planning

Estate planning can be an emotional journey. You're not just dividing assets; you're thinking about the legacy you leave behind. This process often involves sensitive and emotional decisions. ChatGPT, for all its computational might, lacks empathy. It can't sense when to hand you a tissue or crack a joke to lighten the mood. These human elements are irreplaceable in estate planning.

Legal Representation and Advocacy

Imagine a future where ChatGPT could represent you in legal matters. Exciting? Yes. A reality? Not yet. If your estate plan faces challenges, you need a real-life advocate, someone who can stand up in court and defend your wishes. Until AI learns how to don a suit and address a judge, this is a job for human attorneys.

Customization: The Heart of Estate Planning

Every individual is unique, and so is their estate plan. A one-size-fits-all approach doesn't work when it comes to planning for your family's future. ChatGPT may churn out a general document, but it won't capture the essence of your unique situation. Estate planning is about creating a tailored plan that aligns with your specific wishes, assets, and family dynamics.

Conclusion

So, while ChatGPT and its AI cousins are making waves in many fields, let's keep them away from estate planning, at least for now. Estate planning requires a human touch, a deep understanding of legal nuances, and the ability to navigate complex family dynamics. Plus, I'm yet to see an AI that can appreciate a good lawyer joke.

Until AI can sit down with you over a cup of coffee and discuss the ins and outs of your family history and personal wishes, I'll be here, ready to guide you through the intricacies of estate planning – with a smile and a human touch.
