Plan, Establish, Protect — the PEP Framework

A real plan has three parts. Most firms do the first one and hand you a binder.

  • Plan. We build the strategy before we draft a single document — including the long-term-care and tax planning most firms skip entirely.
  • Establish. We retitle the assets, fund the trust, and record the deeds. A plan that is never established is just paper.
  • Protect. Three-year check-ups for life, because your life changes and so does the law.

An unfunded trust is like building a house and never turning the water on. It looks finished from the curb, but your family cannot actually live in it. That middle step — Establish — is where most estate plans quietly fail, and it is the reason we do not consider a plan delivered when the signing is over.

You Leave With a Written Family Protection Report

Using the information you give us beforehand, we spend over an hour preparing your Family Protection Report, and we give it to you at your Strategic Planning Session. It is not a brochure. It is a document about your family — and it is yours to keep whether or not you hire us.

It shows you:

  • Every asset you own, and exactly how each one is titled — because titling, not your will, decides what reaches your family smoothly and what gets caught in probate
  • Your Massachusetts estate tax exposure, calculated both ways: what your family would owe with no plan, and what they would owe with the right one
  • What doing nothing would actually cost — long-term care, guardianship, probate and estate tax, added into a single number
  • A specific recommended plan at a flat price, with the reasoning for why that plan and not a more expensive one
  • What to address first, in order

Most consultations start with someone asking what you have got. Yours starts with the answers.

We Put Our Guarantee in Writing

Most law firms will not guarantee anything. Here is ours: complete your intake, and you leave your Strategic Planning Session with your Family Protection Report and clear next steps for your family — yours to keep, whether or not you work with us. If we do not deliver that, we refund every dollar of your session fee.

Most estate planning firms view your relationship as “done” once you sign the documents. Not at Monteforte Law. It’s our pet peeve to see clients with estate plans that are 20 years old, and that’s the last time they heard from their lawyer! This is the cardinal sin of estate planning lawyers.

For our Advanced Plan clients, 3-Year Check-Ups are built right into the plan. Every three years, we sit down with you to review your documents, discuss updates, and make sure your plan still fits your life, because planning should continue as your life continues.

  • Proactive Planning: Laws change. Family dynamics change. Your estate plan has to change too. Otherwise, it can become totally useless.
  • Stay Current With the Law: Estate, tax, and MassHealth rules shift constantly. Your check-up makes sure your plan reflects today’s rules — not the rules from the year you first signed.
  • Adapt to Life Changes: Marriages, births, deaths, new assets, moves out of state — we review what’s changed in your family and adjust your plan accordingly.

  • We design the plan before drafting anything Most firms start drafting after a short intake call. We start with a Strategic Planning Session — reviewing your assets, family dynamics, and long-term care exposure before a single document is created.
  • We verify how your assets are actually titled Estate planning documents only work if assets are titled correctly. We review real estate ownership, joint accounts, transfer-on-death designations, and trust ownership — something most firms never check.
  • We prepare and record your real estate deeds We don’t just tell you to move property into your trust. We prepare the deed, record it, and confirm recording. That’s real implementation — not a suggestion on a checklist.

Solo Attorney, Big Firm, or Boutique?

Most people pick the wrong size of firm for their estate plan, and the industry has done a poor job explaining the difference.

A solo attorney can be talented and genuinely caring — I was one, for years. The problem is structural.
